Terms of Service

These terms govern the website at umbleh.dev and the services provided by Jaden Mayhue (“umbleh.dev”, “I”, “me”). By using this site or engaging me for work, you agree to them. A signed proposal or written agreement for a specific project takes precedence over anything here if they conflict.

Services

I provide custom website design and development, server provisioning and administration, workflow automation, and ongoing maintenance. The exact scope, deliverables, timeline, and price for any engagement are defined in a written proposal agreed before work begins.

Quotes and payment

• Estimates are based on the scope described to me; changes to scope may change the price and timeline.
• Unless stated otherwise, project work begins after a deposit and is invoiced at agreed milestones.
• Hosting and maintenance are billed on a recurring basis as set out in your plan.
• Late or missed payments may pause work or suspend hosted services.

Your responsibilities

• Provide content, access, and timely feedback needed to complete the work.
• Ensure you have the rights to any materials (text, images, logos) you supply.
• Maintain your own backups of any content you consider critical, in addition to mine.

Intellectual property

Once a project is paid in full, you own the final deliverables produced specifically for you. I may retain ownership of underlying tools, libraries, and reusable components, and I may show the finished work in my portfolio unless we agree otherwise in writing.

Third-party services

Projects may rely on third-party services (for example domain registrars, Cloudflare, or email providers). Their terms and any fees are your responsibility, and I’m not liable for their outages or changes.

Warranties and disclaimer

I take pride in my work and will fix defects in delivered work that you report within a reasonable period. Beyond that, the site and services are provided “as is,” without warranties of any kind, to the fullest extent permitted by law. I don’t guarantee specific search rankings, traffic, or business results.

Limitation of liability

To the fullest extent permitted by law, my total liability for any claim arising from the services is limited to the amount you paid me for the work giving rise to the claim. I’m not liable for indirect, incidental, or consequential damages.

Termination

Either party may end an engagement in writing. You’re responsible for work completed up to the termination date; I’ll deliver paid-for work and assist with a reasonable handover.

Governing law

These terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law rules.
